Please read these terms carefully before using our services.

These Terms and Conditions ("Agreement") govern your use of the services provided by Jake Fixes Tech LLC, a limited liability company organized under the laws of the State of New Hampshire. By using our services you agree to be bound by this Agreement in its entirety. If you do not agree, do not use our services.

Part 1: Tech Repair Services

1. Agreement to Terms

By bringing your device to Jake Fixes Tech LLC, scheduling a service appointment, or authorizing any repair work in person, by phone, by text or by email, you agree to be bound by these Terms and Conditions. Your authorization to proceed with a repair constitutes acceptance of this Agreement.

2. Diagnostic Fee

A non-refundable diagnostic fee of $50 is charged for all repair assessments. This fee covers the time and expertise required to evaluate your device. If you choose to proceed with the recommended repair, the $50 fee will be credited toward your total repair cost. If you decline the repair after diagnosis, the diagnostic fee is retained in full as payment for services rendered. No exceptions.

3. Pricing & Payment

Jake Fixes Tech LLC charges flat-rate pricing for all repair services. All labor fees are due and payable before repair work begins. Parts and components required for a repair are charged separately and will be communicated to you in advance before any parts are ordered or installed. We accept cash, credit/debit card and other payment methods agreed upon in writing.

All sales are final once work has begun. No refunds will be issued for completed labor. If you are dissatisfied with a repair, your sole remedy is the 30-day labor warranty described in Section 5.

Chargebacks: Initiating a chargeback or payment dispute for services legitimately rendered is a breach of this Agreement. Jake Fixes Tech LLC reserves the right to pursue collection of any disputed amount plus associated fees and costs through all available legal remedies.

4. Data Loss & Backup Responsibility

You are solely responsible for backing up all data on your device before submitting it for any service. Jake Fixes Tech LLC is not responsible for any data loss, corruption or inaccessibility that occurs during or as a result of the repair process, regardless of cause.

By leaving your device with us, you acknowledge and accept that data loss is an inherent risk of repair work. You release Jake Fixes Tech LLC, its owner and agents from any and all liability related to lost, corrupted, deleted or otherwise inaccessible data. This release applies even if data loss results from technician error.

If data backup or recovery services are requested, they will be quoted and billed separately.

5. Labor Warranty

Jake Fixes Tech LLC offers a 30-day warranty on labor for all completed repairs. If the exact same issue that was repaired recurs within 30 calendar days of the completed repair date, we will re-address it at no additional labor charge.

This warranty is limited to labor only and expressly does not cover:

  • New, different or unrelated issues that arise after the repair
  • Physical, liquid or accidental damage caused by the customer after pickup
  • Software issues, viruses, malware or operating system problems unrelated to the original repair
  • Defective or failed third-party replacement parts, subject to the parts manufacturer's own warranty if any
  • Damage caused by customer modification, tampering or attempted self-repair after service
  • Normal wear and tear

Warranty service must be requested within the 30-day window. The warranty is void if the device has been tampered with, modified or serviced by any other party after the original repair.

6. Parts & Components

Jake Fixes Tech LLC uses quality third-party replacement parts where original manufacturer (OEM) parts are unavailable or cost-prohibitive. Third-party parts are provided as-is and are subject only to the warranty provided by the parts manufacturer, if any. Jake Fixes Tech LLC makes no independent warranty on third-party parts.

OEM parts can be sourced upon request and may affect pricing and turnaround time. The use of third-party parts may affect manufacturer warranties on your device. Jake Fixes Tech LLC is not responsible for any impact on existing manufacturer warranties.

7. Device Condition & Pre-Existing Damage

Jake Fixes Tech LLC will document the visible condition of your device at intake. We are not responsible for any pre-existing damage, defects or issues that are unrelated to the service being performed. Documentation of pre-existing damage will be communicated to you before work begins.

Some repairs carry an inherent risk of additional damage to fragile or aging components. In cases where such risk exists, Jake Fixes Tech LLC will inform you before proceeding. By authorizing work to continue you accept that risk.

Devices repaired as-is: In some cases a device may be in a condition where repair carries significant risk, such as heavily corroded boards or brittle plastics. If you choose to proceed with service on an as-is device, Jake Fixes Tech LLC is not liable for any damage that occurs as a direct result of the device's pre-existing fragile or compromised condition.

8. Abandoned Devices

Devices not picked up within 30 calendar days of completion or notification of completion will be considered abandoned property. Jake Fixes Tech LLC will make at least two reasonable attempts to contact you using the contact information provided before treating a device as abandoned.

Abandoned devices may be disposed of, disassembled, repurposed or resold at the sole discretion of Jake Fixes Tech LLC to recover unpaid labor and parts costs. Jake Fixes Tech LLC is not liable for any loss of data, software or hardware contained in an abandoned device.

If you are unable to pick up your device within 30 days, please contact us to make alternate arrangements.

9. Right to Refuse or Discontinue Service

Jake Fixes Tech LLC reserves the right to refuse service to any individual or for any device at our sole discretion, without explanation. We also reserve the right to stop work at any time if unforeseen complications, safety concerns or ethical concerns arise during a repair. If work is stopped before completion, you will be charged only for the work completed to that point and your device will be returned to you.

10. Limitation of Liability: Repairs

To the maximum extent permitted by applicable law, Jake Fixes Tech LLC's total liability to you for any claim arising out of or related to repair services shall not exceed the total amount you paid for the specific service giving rise to the claim.

Jake Fixes Tech LLC is not liable for any indirect, incidental, special, consequential, punitive or exemplary damages of any kind. This includes but is not limited to loss of data, loss of business, loss of revenue, loss of profits or cost of replacement devices, even if Jake Fixes Tech LLC has been advised of the possibility of such damages.

11. On-Site Tech Support

On-site service is billed at an hourly rate communicated and agreed upon before the visit. A minimum charge of one hour applies to all on-site visits. Travel time may be included in the hourly rate depending on distance and will be disclosed in advance. Payment for on-site visits is due upon completion of the service call. Jake Fixes Tech LLC reserves the right to require a deposit before scheduling on-site visits.

Part 2: Web Design & Management Services

12. Agreement to Web Services Terms

By engaging Jake Fixes Tech LLC for any web design, development or management service, including by paying a deposit, signing a proposal or authorizing work to begin, you agree to the terms in this section in addition to the general terms above. These terms apply to all website build packages, management plans and on-demand hourly work.

13. Web Services Payment Terms

All website build projects require a 50% non-refundable deposit before work begins. The deposit is non-refundable regardless of whether the project is completed, as it compensates Jake Fixes Tech LLC for time, planning and resources committed to your project. The remaining 50% is due upon completion and before the website is launched or any deliverables are handed over.

If final payment is not received within 14 calendar days of project completion, Jake Fixes Tech LLC reserves the right to withhold delivery of all files, assets and access until payment is received in full. Interest may accrue on overdue balances at a rate of 1.5% per month.

On-demand hourly work is billed in 1-hour minimums. Invoices for hourly work are due within 14 calendar days of the invoice date. Late payment may result in work being paused until the balance is cleared. Jake Fixes Tech LLC is not responsible for any delays or consequences resulting from a work pause due to non-payment.

Chargebacks: Initiating a chargeback for web services legitimately rendered is a breach of this Agreement. Jake Fixes Tech LLC reserves the right to pursue full recovery of any disputed amounts plus fees through all available legal remedies.

14. Project Scope & Revisions

Each build package includes a defined number of revision rounds as stated on the Web Services page and confirmed at project start. A revision round is defined as a single consolidated set of changes submitted at one time via written communication. Multiple separate submissions do not constitute a single revision round.

Additional revisions beyond the included rounds are billed at $75/hour with a one-hour minimum. Any requests that fall outside the originally agreed scope, including additional pages, new features, substantial redesigns or major content restructuring, are out-of-scope and will be quoted and billed separately before work proceeds.

Jake Fixes Tech LLC will not begin out-of-scope work without written confirmation of approval from the client.

15. Client Responsibilities

The client is responsible for providing all content required for the website in a timely manner. This includes written copy, images, logos, brand guidelines, colors, fonts and any third-party credentials or integrations needed for the build. Jake Fixes Tech LLC is not responsible for sourcing, writing or acquiring client content unless separately agreed upon in writing.

If the client does not respond to requests for content, feedback or approval within 7 calendar days, the project will be paused. Projects paused for more than 30 calendar days due to client inaction may be subject to a project restart fee. Jake Fixes Tech LLC is not responsible for any timeline delays caused by client inaction.

The client is responsible for ensuring that all content provided to Jake Fixes Tech LLC does not infringe on any third-party copyright, trademark or other intellectual property rights. Jake Fixes Tech LLC is not liable for any legal claims arising from client-provided content.

16. Project Timeline

Jake Fixes Tech LLC will provide an estimated project timeline at the start of each engagement. All timelines are good-faith estimates and are not guarantees of delivery. Jake Fixes Tech LLC is not liable for delays caused by client inaction, late content delivery, change requests or circumstances outside our reasonable control, including third-party service outages, illness or force majeure events.

17. Website Ownership & Intellectual Property

Upon receipt of full and final payment, the client owns their completed website including all custom code, design assets and content created specifically for their project. Jake Fixes Tech LLC retains no ownership claim over the delivered work after final payment is received.

Until final payment is received in full, all website code, designs, mockups and related assets remain the exclusive intellectual property of Jake Fixes Tech LLC. The client has no right to use, publish, transfer or build upon any deliverables until payment is complete.

Portfolio use: Jake Fixes Tech LLC reserves the right to display completed websites in a portfolio, on social media or as examples of work for marketing purposes. If the client wishes to opt out of portfolio display, they must submit a written request before project completion. Portfolio display rights survive payment and termination of this Agreement.

Third-party tools, frameworks, fonts or libraries used in the project are subject to their own respective licenses, which are not transferred as part of this Agreement.

18. Domain & Hosting

Where Jake Fixes Tech LLC registers a domain on behalf of a client, the domain will be registered in the client's name and transferred to the client's control upon final payment. Clients are responsible for renewing their own domain names unless enrolled in a management plan that explicitly includes domain renewal services.

Jake Fixes Tech LLC uses Cloudflare Pages for website hosting. Hosting through Cloudflare Pages is provided at no additional cost as part of the build. Jake Fixes Tech LLC is not responsible for any service disruptions, downtime or changes to Cloudflare's platform or pricing. If Cloudflare modifies or discontinues free hosting, Jake Fixes Tech LLC will notify affected clients but is not obligated to absorb any resulting costs.

If a client cancels a management plan, their website will remain live on Cloudflare Pages under their own account. Jake Fixes Tech LLC will cease all management activities at the end of the final paid billing period.

19. Management Plan Terms & Cancellation Policy

Management plans are optional recurring services separate from the one-time build fee. Plans renew automatically unless cancelled. Pricing is as follows:

Cancellation policy:

  • Monthly plans: Cancel anytime with 30 days written notice. No refund for the current billing month.
  • Quarterly plans: No refund after the first 14 calendar days of the billing period.
  • Annual plans: No refund after the first 30 calendar days of the billing period.

All cancellation requests must be submitted in writing via email to jake@jakefixestech.com. Cancellation is not effective until confirmed in writing by Jake Fixes Tech LLC. Upon cancellation the client retains full ownership of their website. Jake Fixes Tech LLC will cease management activities at the end of the final paid period.

20. Limitation of Liability: Web Services

Jake Fixes Tech LLC is not liable for any loss of business, revenue, data, traffic, search rankings or reputation arising from website downtime, errors, bugs, performance issues or third-party service outages. Our total liability for any web services claim shall not exceed the total amount paid by the client for the specific project or billing period giving rise to the claim.

Jake Fixes Tech LLC is not responsible for outages or disruptions caused by Cloudflare, domain registrars, payment processors or any other third-party service. We are not liable for any loss resulting from a client's failure to renew their domain or maintain their own account credentials.

21. Accessibility Compliance

Jake Fixes Tech LLC builds all new websites to meet WCAG 2.1 Level AA accessibility standards at the time of delivery. Accessibility services apply exclusively to websites built from scratch by Jake Fixes Tech LLC and do not include remediation, auditing or retrofitting of pre-existing websites built by other parties.

Compliance is verified at delivery using the WAVE accessibility evaluation tool and manual testing. A passing accessibility report will be provided with Professional and Premium package deliveries.

Post-delivery responsibility: Jake Fixes Tech LLC is not responsible for maintaining accessibility compliance on content added or modified by the client after delivery. This includes images without alt text, low-contrast color changes, third-party embeds or any structural modifications made outside a Jake Fixes Tech LLC management plan.

ADA Accessibility Recommendation Waiver: If a client requests content or design choices that do not meet WCAG AA standards, Jake Fixes Tech LLC will inform the client in writing and recommend correction. If the client elects to proceed despite this recommendation, they must sign a separate ADA Accessibility Recommendation Waiver before work continues. This waiver documents that Jake Fixes Tech LLC identified and disclosed the accessibility concern and that the client accepted full liability for any resulting legal claims, fines or regulatory action. Jake Fixes Tech LLC is not liable for any ADA-related legal claims arising from client-directed non-compliant design choices.

Illegal Content

22. Discovery of Illegal Content

In the course of performing diagnostic or repair work, Jake Fixes Tech LLC may incidentally encounter content stored on a device. While we do not intentionally browse personal files, photos or documents, illegal content may be discovered in the normal course of completing a repair.

Child Sexual Abuse Material (CSAM): Under federal law (18 U.S.C. § 2258A), any electronic service provider who discovers child sexual abuse material is legally required to report it to the National Center for Missing & Exploited Children (NCMEC) CyberTipline. Jake Fixes Tech LLC will comply fully with this legal obligation without exception. If such material is discovered:

  • All work on the device will stop immediately
  • The device will be preserved and handled as potential evidence
  • A report will be filed with NCMEC and law enforcement as required by law
  • The device may be turned over to law enforcement upon request
  • No refund of any fees paid will be issued

Other Illegal Content: If other clearly illegal content is discovered, including but not limited to illegal firearms-related files or evidence of criminal activity, we reserve the right to:

  • Stop work on the device immediately
  • Report the discovered content to appropriate law enforcement authorities
  • Cooperate fully with any resulting law enforcement investigation
  • Retain the device pending law enforcement guidance if requested

Pirated Software & Media: If a device is found to contain clearly pirated software, games or media, Jake Fixes Tech LLC reserves the right to decline further service. No refund of the diagnostic fee will be issued in this circumstance.

Jake Fixes Tech LLC is not liable for any legal consequences arising from the discovery and reporting of illegal content found on a customer's device. By leaving your device with us you acknowledge and accept this policy.

General Provisions

23. Force Majeure

Jake Fixes Tech LLC is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control. This includes but is not limited to natural disasters, power outages, supplier failures, illness, government orders, pandemics or any other event outside our control. In the event of such a circumstance, Jake Fixes Tech LLC will notify you as soon as reasonably practicable and will resume performance when circumstances permit.

24. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions. Any disputes arising out of or relating to this Agreement that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts located in Grafton County, New Hampshire.

Before pursuing any formal legal action, both parties agree to make a good-faith effort to resolve the dispute directly. You agree to contact Jake Fixes Tech LLC at jake@jakefixestech.com before initiating any legal proceeding.

Any claim arising out of or related to this Agreement must be brought within one year of the date the claim arose or it shall be permanently barred.

25. Severability

If any provision of this Agreement is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions shall continue in full force and effect.

26. Entire Agreement

This Agreement constitutes the entire agreement between you and Jake Fixes Tech LLC with respect to the subject matter herein. It supersedes all prior or contemporaneous communications, representations or agreements, whether written or oral. Any modification to this Agreement must be made in writing and acknowledged by Jake Fixes Tech LLC.

27. Changes to Terms

Jake Fixes Tech LLC reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on this page with a revised date. Continued use of our services after the posting of changes constitutes your acceptance of the revised terms. For significant changes, we will make reasonable efforts to notify active clients.
